Terms of Service

By creating an account or using any part of the Platform, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms, you must not use the Platform.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

You must be at least 13 years old to use the Platform. If you are under 18, you represent that you have parental or guardian consent. Certain features (shopping, creator monetization, live streaming) require you to be at least 18 years old.

2.1 Account Creation. You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

2.2 One Account Per Person. Each person may maintain only one account. Creating multiple accounts to circumvent bans, manipulate features, or deceive other users is prohibited.

2.3 Account Security. You must immediately notify us of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

2.4 Account Verification. We may require identity verification for certain features, including creator monetization, purchasing, and age-restricted content. Failure to verify when requested may result in feature restrictions.

3.1 Your Content. You retain ownership of content you post on the Platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with the Platform's operation and promotion.

3.2 Content Standards. All content must comply with our Community Guidelines. Content must be beauty-related or relevant to the community. You must have the right to post any content you share.

3.3 Sponsored Content. If you receive compensation for content (including free products), you must clearly disclose this relationship using our built-in sponsorship disclosure tools or appropriate hashtags (#ad, #sponsored, #gifted).

3.4 Content Moderation. We reserve the right to remove content that violates these Terms or our Community Guidelines. Repeated violations may result in account suspension or termination.

4.1 Creator Program. Approved creators may access monetization features including product sales, affiliate commissions, tipping, and paid content. Creators must agree to our separate Creator Agreement.

4.2 Revenue Share. Creators receive 80% of revenue from sales made through their shops. Affiliate commissions are 15% of qualifying purchases made through creator links.

4.3 Tax Obligations. Creators are responsible for reporting and paying all applicable taxes on their earnings. We may issue tax forms (1099, W-9) as required by law.

4.4 Creator Conduct. Creators must maintain professional standards, respond to customer inquiries within 48 hours, and accurately represent products they sell or promote.

5.1 Purchases. All purchases made through the Platform are final unless otherwise stated. Prices are displayed in USD unless you select a different currency. Applicable taxes are calculated at checkout.

5.2 Refunds. Physical products may be returned within 30 days if unused and in original packaging. Digital content (tutorials, courses) is non-refundable once accessed. Defective or misrepresented products are eligible for full refunds.

5.3 Payment Processing. Payments are processed by our third-party payment processor (Stripe). We do not store full credit card numbers on our servers.

5.4 Creator Payouts. Creator earnings are paid out upon request with a minimum threshold of $25. Payouts are processed within 2-5 business days.

The following are strictly prohibited on the Platform:

• Harassment, bullying, hate speech, or discrimination based on any protected characteristic
• Spam, misleading content, or fake reviews
• Counterfeit or unauthorized products
• Content that infringes on intellectual property rights
• Harmful or dangerous beauty practices (e.g., unsafe DIY procedures)
• Unauthorized collection of user data or scraping
• Attempts to manipulate algorithms, rankings, or engagement metrics
• Impersonating other users, brands, or public figures
• Distributing malware or attempting to compromise platform security
• Selling products that violate FDA regulations or contain banned ingredients

7.1 Platform IP. The Makeup Fetish name, logo, design, features, and technology are owned by Makeup Fetish, Inc. and are protected by copyright, trademark, and other intellectual property laws.

7.2 User Content. You retain all rights to content you create and post. The license you grant us is limited to operating and promoting the Platform and terminates when you delete your content or account (except for cached or archived copies).

7.3 DMCA. We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your content has been infringed, contact us at legal@makeupfetish.com with the required information.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. AI-powered features (shade matching, skin analysis, product recommendations) are provided for informational purposes only and should not replace professional dermatological advice.

We are not responsible for the accuracy of user-generated content, product reviews, or third-party product claims. Product results may vary based on individual skin characteristics.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEUP FETISH, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability to you for any claims arising from or related to your use of the Platform shall not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) $100.

This limitation applies to all claims, whether based in contract, tort (including negligence), strict liability, or any other legal theory.

10.1 By You. You may delete your account at any time through your account settings. Account deletion is permanent and cannot be undone. Your content will be removed, though cached versions may persist temporarily.

10.2 By Us. We may suspend or terminate your account if you violate these Terms, our Community Guidelines, or applicable laws. We will provide notice when possible, but reserve the right to act immediately in cases of severe violations.

10.3 Effect of Termination. Upon termination, your right to use the Platform ceases immediately. Pending creator payouts will be processed for legitimate earnings. Sections of these Terms that by their nature should survive will continue to apply.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the state or federal courts located in Los Angeles County, California.

For disputes under $10,000, either party may elect to resolve the dispute through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. Each party bears its own costs in arbitration.
